Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“End-User”) and Owyhee Holdings LLC, doing business as Metar Echo (“Metar Echo,” “we,” “us,” or “our”) regarding your use of the Metar Echo iOS application (the “App,” “Licensed Application,” or “Service”).

By using the App, you acknowledge that:

  • These Terms are concluded between you and Metar Echo only, and not with Apple, Inc.
  • Metar Echo, not Apple, is solely responsible for the Licensed Application and its content
  • You have read, understood, and agree to be bound by these Terms and our Privacy Policy

If you do not agree to these Terms, do not use the App.

THE APP USES ARTIFICIAL INTELLIGENCE TO GENERATE WEATHER ANALYSIS. AI-GENERATED INFORMATION MAY BE INCOMPLETE, INACCURATE, OR INCORRECT.

  • Verify all information with official sources before relying on it for flight operations
  • Cross-check weather data against current FAA weather briefings
  • Confirm conditions with Flight Service or other official sources
  • Do not rely solely on AI analysis for critical safety decisions

Pilot in Command Authority

Per 14 CFR § 91.3 (Federal Aviation Regulations), the pilot in command is directly responsible for and is the final authority as to the operation of the aircraft.

The App is provided for informational and convenience purposes only. It does not:

  • Replace your responsibility as pilot in command
  • Substitute for official FAA weather briefings
  • Serve as the sole source for weather information
  • Override official weather sources or procedures
  • Constitute professional advice from a meteorologist

You remain solely responsible for:

  • Obtaining official weather briefings before flight
  • Verifying all weather information with authoritative sources
  • Making final go/no-go decisions
  • Operating within the limitations of your certificates and ratings
  • Ensuring safe flight operations

Informational Analysis Only

CRITICAL: The App provides INFORMATIONAL analysis only. It does NOT make operational decisions.

When the App provides weather analysis, it:

  • Presents data and conditions as they exist
  • May highlight trends or considerations
  • Does NOT make deterministic safety recommendations
  • Does NOT tell you whether it’s safe to fly

The App will NEVER state:

  • “Safe to fly”
  • “No issues”
  • “Good to go”
  • Or any similar operational clearance

You MUST:

  • Obtain official weather briefings from FAA-approved sources
  • Verify all data before flight
  • Make your own informed decisions
  • Never rely on the App as your sole weather source

Weather Data Accuracy

THE APP USES THIRD-PARTY WEATHER DATA SOURCES

We do NOT guarantee that weather data is:

  • Accurate or complete
  • Timely or current
  • Properly formatted
  • Free from errors or omissions

Weather data may be:

  • Delayed or outdated
  • Incomplete or missing
  • Incorrectly parsed or displayed
  • Different from official sources

Specific Weather Limitations:

METAR/TAF Data:

  • May be delayed from observation time
  • May be incomplete or missing elements
  • Parsing errors may occur
  • Always verify with official sources

PIREPs (Pilot Reports):

  • Provided as-is from FAA sources
  • May be outdated or inaccurate
  • Represent conditions at specific times/locations
  • Not predictive of current conditions

AIRMETs/SIGMETs:

  • Hazard detection is automated and may be incorrect
  • Boundaries may be imprecise
  • May not reflect the most current advisories
  • Always check official sources

Density Altitude:

  • Calculated from METAR data
  • Accuracy depends on data quality
  • Not a substitute for proper performance calculations
  • Verify with aircraft performance charts

Eligibility and User Representations

To use the App, you must:

  • Be at least 13 years of age
  • Be legally capable of entering into binding contracts
  • Comply with all applicable aviation regulations and laws

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country
  • You are not listed on any U.S. Government list of prohibited or restricted parties

Service Description and Limitations

What the App Provides

The App offers:

  • METAR and TAF decoding and display
  • Weather hazard identification
  • Nearby PIREP display
  • Home screen widgets
  • Cloud layer visualization
  • Plus subscribers: AI weather analysis, smart refresh, and density altitude calculations

Service Limitations

The App does NOT:

  • Provide official FAA weather briefings
  • File flight plans
  • Replace official weather sources
  • Guarantee accuracy, completeness, or timeliness of information
  • Provide real-time weather radar
  • Provide TFR (Temporary Flight Restriction) information

Beta and Experimental Features

The App may include beta or experimental features (“Beta Features”):

Beta Features Disclaimer:

  • Provided AS-IS with no warranties
  • May be discontinued or modified at any time
  • May contain bugs or errors
  • May cause data loss or service interruptions
  • Not recommended for critical operations

Your Responsibility:

  • Use Beta Features at your own risk
  • Do not rely on Beta Features for safety-critical functions
  • Understand that Beta Features may become paid features

The free version includes:

Plus Subscription

Plus subscribers ($4.99/month or $49.99/year) receive:

  • Everything in free tier
  • Unlimited favorite airports
  • AI weather analysis
  • Density altitude calculations
  • Smart refresh
  • Future premium features

Subscription Terms

  • Subscriptions are managed through Apple App Store
  • Payment is processed by Apple, not Metar Echo
  • Subscriptions auto-renew unless cancelled
  • Cancel anytime in iOS Settings → Apple ID → Subscriptions
  • No refunds for partial periods
  • Price changes require 30 days notice

Free Trial

  • Plus subscription includes a 7-day free trial
  • Cancel before trial ends to avoid charges
  • Trial available once per Apple ID

Acceptable Use Policy

Permitted Uses

You agree to use the App:

  • In compliance with all applicable aviation regulations
  • For lawful purposes only
  • For personal, non-commercial use
  • Respectfully and professionally

Prohibited Activities

You may NOT:

  • Use the App as your sole weather source for flight operations
  • Rely on the App in place of official weather briefings
  • Use the App while acting as pilot in command during flight
  • Copy the App (except as permitted by this license and Apple’s Usage Rules)
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Modify or create derivative works of the App or any updates (except to the extent prohibited by applicable law or permitted by open-source licensing terms)
  • Transfer, redistribute, or sublicense the App
  • Distribute or make the App available over a network where it could be used by multiple devices simultaneously
  • Attempt to gain unauthorized access to the App or our systems
  • Use automated systems (bots, scrapers) to access the App
  • Use the App to build a competing product
  • Export or re-export the App except as authorized by United States law and the laws of the jurisdiction where obtained

Scope of License

The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

This Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

Intellectual Property Rights

App Content

The App, including its software, design, algorithms, and content, is owned by Metar Echo and is protected by copyright, trademark, and other laws.

You acknowledge that:

  • In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, Metar Echo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim

Your Data

You retain ownership of your airport preferences and settings. By using the App, you grant Metar Echo a license to:

  • Store and process your data to provide the Service
  • Use anonymized, aggregated data to improve the App

Third-Party Content

The App includes:

  • Weather data from official government sources (public domain)
  • Airport information (public domain or licensed)

Maintenance and Support

Metar Echo is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms, or as required under applicable law.

You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

Disclaimers and Limitation of Liability

NO WARRANTY

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability or fitness for a particular purpose
  • That the App will be error-free, secure, or uninterrupted
  • That weather information will be accurate, complete, or current
  • That AI-generated analysis will be correct or reliable

Metar Echo is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Licensed Application to conform to any applicable warranty:

  • You may notify Apple, and Apple will refund the purchase price for the Licensed Application to you (if applicable)
  • To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application
  • Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Metar Echo’s sole responsibility

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Metar Echo SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, data, or opportunities
  • Aircraft accidents, incidents, or damage
  • Weather-related incidents or decisions
  • Reliance on AI-generated information
  • Service interruptions or data loss
  • Inaccurate or delayed weather data

TO THE EXTENT NOT PROHIBITED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PLUS SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Product Claims and Responsibility

You acknowledge that Metar Echo, not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:

  • Product liability claims
  • Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
  • Claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application’s use of location services

Aviation-Specific Disclaimers

Metar Echo IS NOT RESPONSIBLE FOR:

  • Weather-related flight decisions
  • Accidents or incidents
  • Pilot error or lack of currency
  • Violations of FARs or other regulations
  • FAA enforcement actions
  • Insurance claim denials
  • Delayed or inaccurate weather data
  • AI analysis errors or omissions

Specific Scenarios Where Metar Echo Is Not Liable:

  • You rely on the App without obtaining official weather briefings
  • The App shows favorable conditions but actual weather is different
  • AI analysis is incorrect or misleading
  • Weather data is delayed or inaccurate
  • You make a go/no-go decision based on App information
  • An accident occurs and weather was a factor

You acknowledge that:

  • Aviation inherently involves risks
  • You assume all risks associated with flight operations
  • The App is a supplemental tool only
  • You are solely responsible for all flight decisions
  • No app can replace proper weather briefing procedures

Indemnification

You agree to indemnify, defend, and hold harmless Metar Echo from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any aviation regulations
  • Aircraft accidents or incidents
  • Your reliance on App-provided information
  • Weather-related decisions

Third-Party Services and Terms of Agreement

The App integrates with third-party services:

  • Apple App Store (subscription management)
  • U.S. Government Sources: FAA/NOAA/NWS (weather data)
  • AI providers (weather analysis for Plus subscribers)

You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, if you use the App while connected to a wireless data service, you must not be in violation of your wireless data service agreement.

These third parties have their own terms and privacy policies. We are not responsible for:

  • Third-party service availability or reliability
  • Third-party data accuracy or security
  • Third-party terms or pricing changes

Data and Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference.

Consent to Use of Data:

You agree that Metar Echo may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the App.

Metar Echo may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

Service Availability and Modifications

No Uptime Guarantee

We strive for high availability but do not guarantee uninterrupted access. The App may be unavailable due to:

  • Scheduled maintenance
  • Technical difficulties
  • Third-party service outages (weather data, AI providers)
  • Force majeure events

Service Modifications

We reserve the right to:

  • Modify or discontinue features with or without notice
  • Change the App’s functionality or interface
  • Update system requirements
  • Implement usage limits or restrictions

We are not liable for any modification, suspension, or discontinuation of the App.

Termination

Termination by You

You may stop using the App at any time by:

  • Deleting the App from your device
  • Cancelling your Plus subscription via Apple
  • If you sell your Apple device to a third party, you must remove the App from the device before doing so

Termination by Us

We may terminate or suspend your access if:

  • You breach these Terms
  • Your use creates safety or security risks
  • We are required by law or regulation
  • We cease offering the App

Effect of Termination

Upon termination:

  • Your rights under these Terms terminate automatically if you fail to comply with any term
  • Your access to the App ends immediately
  • Local data is deleted when you uninstall the App
  • iCloud data is removed if you disable iCloud sync
  • Subscription obligations survive termination

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions, except to the extent that:

  • If you are not a U.S. citizen, do not reside in the U.S., are not accessing the Service from the U.S., and are a citizen of a European Union country, Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence

The United Nations Convention on the International Sale of Goods is specifically excluded from application to these Terms.

Arbitration Agreement

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising from these Terms or the App shall be resolved by binding arbitration rather than in court, except:

  • Small claims court disputes (under $10,000)
  • Intellectual property disputes
  • Emergency injunctive relief

Opt-Out Right:

If you are a new user, you may opt out of this Arbitration Agreement within thirty (30) days of first accepting these Terms by:

  • Emailing legal@metarecho.com with your name
  • Stating clearly: “I opt out of the Arbitration Agreement”

Opting out does not affect any other part of these Terms. You cannot opt out after the 30-day period expires.

Arbitration Terms:

  • Administered by the American Arbitration Association (AAA)
  • AAA’s Commercial Arbitration Rules apply
  • One arbitrator selected per AAA procedures
  • Location: Remote by video or mutually agreed location
  • Arbitrator’s decision is final and binding

Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY, NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Metar Echo regarding the App.

Modifications to Terms

We may modify these Terms at any time. Material changes will be notified via:

  • In-app notification
  • Email (if provided)
  • Notice on our website

Continued use after changes constitutes acceptance.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any successor or affiliate.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, wars, network failures, or third-party service outages.
